Criminal trials are never easy but the more you know the more relaxed you become about them. As usual, there will be 25 issues for consideration during this 1-hour presentation and you may find, upon reading them, that there are things that you have never even considered!

The following 25 issues will be considered:
1 – The non-appearance of your client – thoughts for your consideration
2 – The non-appearance of your crucial defence witness – thoughts for your consideration
3 – The non-appearance of prosecution witnesses – opposing the application for the adjournment
4 – Options available for the prosecution where the trial cannot proceed today – remember, too late to withdraw the proceedings – discontinuance or the prosecution offering no evidence and the charge being dismissed – Autre-fois Acquit – Functus Officio – the meaning of these terms
5 – The issue of costs – a consideration of the Prosecution of Offences Act 1985, and the Criminal Procedure Rules 2020 (as amended)
6 – Dealing with Hearsay as and when it crops up during the trial itself!
7 – Dealing with Bad Character as and when it crops up during the trial itself!
8 – Admissibility issues – the client turns up for trial with a set of photographs – how are you going to get these admitted in evidence?
9 – The first rule of evidence – RELEVANCE
10 – The circumstances in which you may agree that the entirety of the prosecution evidence can be read
11 – The Court has run out of time and is proposing to adjourn part-heard – the proposed resumption date is some 6 months hence – is this too long? – What does the case-law say?
12 – What you can and cannot do for the client where you have written on the PET Form that the prosecution is put to the proof of its case
13 – The prosecution witness who turns hostile
14 – The client who turns up late after the first witness has already testified – thoughts for your consideration
15 – Advising on the merits of an appeal against the conviction or against the sentence or against both
16 – The new rates of pay for all of this where the determination that the client qualifies for legal aid is made on or after 30th September 2022 – Statutory Instrument 2022 No. 848
17 – The client who misbehaves during the currency of the trial – options for the Court
18 – Advising the client as to whether or not he should testify at the trial
19 – The Court has decided that the trial will take place in absence as the Court has not been given a good reason for the defendant’s non-appearance – thoughts for your consideration
20 – Exhibits generally
21 – Legal presumptions that operate in favour of the Crown
22 – Statutory assumptions that operate during a trial
23 – Body cam footage and 999 calls
24 –The defendant giving evidence of that which took place in the private consultation at the police station
25 – The golden rule in relation to a closing speech
