The Online Safety Act 2023 – 9 NEW CRIMINAL OFFENCES came into force on the 31st January 2024

The Police, Crime, Sentencing and Courts Act 2022 – large parts of this Act are now in force and have brought about wholesale amendments to criminal law

The Judicial Review and Courts Act 2022 – important new powers for Crown Court Judges

The following 25 ISSUES will be considered:

1 – Section 179 of the Online Safety Act 2023 – the sending of false communications

2 – Section 181 of the Online Safety Act 2023 – the sending of threatening communications

3 – Section 183 of the Online Safety Act 2023 – offences relating to sending or showing flashing images

4 – Section 184 of the Online Safety Act 2023 – the offence of encouraging or assisting serious self-harm

5 – A new Section 66A of the Sexual Offences Act 2003 – the offence of sending a photograph or film of a person’s genitals

6 – A new Section 66B (1) of the Sexual Offences Act 2003 – the offence of sharing photographs or film of an intimate nature

7 – A new Section 66B (2) of the Sexual Offences Act 2003 – the offence of sharing photographs or film of an intimate nature intending to cause alarm, humiliation or distress

8 – A new Section 66B (3) of the Sexual Offences Act 2003 – the offence of sharing photographs or film of an intimate nature for the purpose of obtaining sexual gratification

9 – A new Section 66B (4) of the Sexual Offences Act 2003 – the new offence of threatening to share photographs or film

10 – Common assault or battery within a domestic context – the time for bringing the prosecution – important

amendments under the Police, Crime, Sentencing and Courts Act 2022

 11 – Increased sentencing powers in relation to causing death by dangerous driving and the ramifications in terms of the proportion of sentence which must be served by adults – important amendments under the Police, Crime, Sentencing and Courts Act 2022

12 – Increased sentencing powers in relation to causing death by careless driving when under the influence of drink or drugs and the ramifications in terms of the proportion of sentence which must be served by adults – important amendments under the Police, Crime, Sentencing and Courts Act 2022

13 – New definitions of those occupying a Position of Trust whereby in order for the activity to be both consensual and lawful the other party must be 18 or over – important additions to the definition under the Police, Crime, Sentencing and Courts Act 2022

14 – The new road traffic offence introduced under the Police, Crime, Sentencing and Courts Act 2022 in relation to causing serious injury by careless or inconsiderate driving – + the new Guidelines from the Sentencing Council with effect from 1st July 2023

15 – Adult clients given 4 years custody or more for certain offences under Schedule 18 of the Sentencing Act 2020 – release provisions as a result of the amendments made by the Police, Crime, Sentencing and Courts Act 2022

16 – The 3 road traffic offences mentioned in Schedule 18 of the Sentencing Act 2020 and for which your client could be sentenced under the Dangerous Offender provisions

17 – Amendments to section 67 of the Sexual Offences Act 2003 as regards those people who engage in voyeurism by means of operating equipment or recording any image re breastfeeding – amendments as a result of the Police, Crime, Sentencing and Courts Act 2022

18 – Amendments to Section 2A of PACE in terms of people having to go to the police station in order to give their biometric material (fingerprints and DNA and photograph) as a result of the Police, Crime, Sentencing and Courts Act 2022

19 – All change with minimum sentences as a result of the Police, Crime, Sentencing and Courts Act 2022

20 – Increase in requisite custodial period for ‘offenders of particular concern’ as a result of the changes under the Police, Crime, Sentencing and Courts Act 2022

21 – Amendments to the remands of Youths as a result of the Police, Crime, Sentencing and Courts Act 2022

22 – Amendments to Detention and Training Orders as a result of the Police, Crime, Sentencing and Courts Act 2022

23 – The power of the Crown Court Judge to send a youth back to the Youth Court for trial under the Judicial Review and Courts Act 2022

24 – The power of the Crown Court Judge under the Judicial Review and Courts Act 2022 to remit an adult defendant to a Magistrates’ Court for sentence where the matter had been committed to the Crown Court for sentence

25 – The power of the Crown Court Judge under the Judicial Review and Courts Act 2022 to remit an adult defendant to the Adult Magistrates’ Court for trial
